Lawmakers Move to Expand Public Smoking Ban to Include Marijuana

Florida Sen. Joe Gruters on Friday filed legislation that would expand Florida’s Clean Indoor Air Act to explicitly prohibit the smoking or vaping of marijuana in public places statewide.

The bill, Senate Bill 986, would broaden existing law, which currently targets tobacco use in enclosed indoor workplaces, to include marijuana smoke and vapor and to cover a wide range of outdoor public spaces.

Under the proposal, smoking or vaping marijuana would be banned in any “public place,” a term newly defined in statute to include streets, sidewalks, parks, beaches, and common areas of schools, hospitals, and various public settings. The definition applies to both indoor and outdoor areas accessible to the public.

In addition, SB 986 updates statutory definitions of “smoking” and “vaping” to explicitly include marijuana products, while clarifying that mere possession of a vaping device is not prohibited. The legislation further bars marijuana smoking or vaping in customs smoking rooms at airports, even where tobacco smoking may still be permitted under federal authority.

The bill does not address the legality of marijuana itself but focuses on regulating where marijuana products may be smoked or vaped in the interest of public health.

If approved, the measure would take effect July 1, 2026.

Rep. Alex Andrade filed a similar measure in the House, House Bill 389, that would make nearly identical changes to state law.
